Preamble:

These general terms and conditions of sale are concluded between, on the one hand, the company SARL CFM, official distributor of the brand United Souls (hereinafter referred to as UnitedSouls.fr), with a capital of 500 Euros, registered in the Bordeaux Trade and Companies Register under number 52957266100031, whose registered office is located at 30 rue Bouquière, 33000 Bordeaux, engaged in remote sales of t-shirts via the Internet on the website www.unitedsouls.fr, which it manages. And, on the other hand, individuals or legal entities (hereinafter referred to as the client) wishing to make a purchase via the website www.unitedsouls.fr of United Souls.

The parties agree that their relationship will be governed exclusively by this contract, to the exclusion of any condition previously available on the site. The client declares having taken note of the following provisions before placing an order for the products.

Article 1: Purpose of the contract

These general terms and conditions of sale aim to define the terms applicable to the commercial relationship between United Souls and the client, from the order to services, including payment and delivery. These general terms and conditions of sale may only be modified by United Souls.

Article 2: Legal age

The client declares having the capacity to conclude this contract, meaning being of legal age and not being under guardianship or curatorship.

Article 3: Order registration

Any order on the website www.unitedsouls.fr implies the client's agreement to these general terms and conditions of sale; these provisions, readable on the homepage of the website www.unitedsouls.fr via a hyperlink, are available for consultation at any time. On the website www.unitedsouls.fr, the order validation process takes place through successive data entries allowing the client to make potential modifications to their order before the final summary and definitive registration of it. To enable the client to review their order to verify its contents and correct any errors, www.unitedsouls.fr has created several validation and acceptance screens. The order will only be definitively registered upon the third and final validation of the order summary screen and the total price of this order. This final "click" is equivalent to a handwritten signature as referred to in Article 1341 of the French Civil Code, referred to as the "click of acceptance." Any order implies acceptance of the prices and the description of the products available for sale. www.unitedsouls.fr commits to honoring the orders received on its website only within the limits of available product stocks. In case of unavailability of the product, www.unitedsouls.fr commits to informing the client as soon as possible.

Article 4: Order confirmation

Upon receipt of the order by www.unitedsouls.fr, an electronic message is sent to the client by www.unitedsouls.fr to confirm that their order has been taken into account. By retaining this electronic message and/or printing it, the client holds proof of their order, which www.unitedsouls.fr recommends keeping as proof of order. The delivery time starts to run from the order date, if it is placed before 12:00 PM and on a working day. If the order is placed after 12:00 PM and on a working day, the delivery time starts from the next working day following the order date. In the event of stock shortage, www.unitedsouls.fr will contact the client within seven working days from the sending of the confirmation email to propose either a new delivery date, which the client already accepts, or the cancellation of the order.

Article 5: Prices, payment, and invoicing

The prices of the products are indicated in euros including all taxes (TTC), excluding shipping costs. The shipping costs mentioned in Article 9 of these general terms and conditions are the responsibility of the client (unless specified otherwise). The accepted payment methods are credit card, bank check, and bank transfer. The invoice for the product will be available in the client’s personal space "My Account" on the site. The client’s account will only be debited for the amount of the products ordered that are actually shipped.

Article 6: Payment terms

The client must pay in euros to www.unitedsouls.fr the price of the ordered products and must make their purchases online at the time of the order by credit card, bank check, or bank transfer.

Article 7: Transaction security

To optimize the security of online transactions, a payment system is offered to the client that encrypts the client’s credit card number. The payment method proposed by www.unitedsouls.fr is a secure SSL (Secure Socket Layer) payment, which is a standard payment protocol recognized worldwide for the protection of data transmitted over the Internet. It is available on almost all browsers (Chrome, Firefox, Safari, Opera, Internet Explorer V3.02 and later from Microsoft, Navigator V1.1 and later from Netscape, etc.). The data provided by the client on their credit card (number, expiration date, etc.) is encrypted before being sent to the payment server. However, the guarantees provided by www.unitedsouls.fr regarding the security of transactions are identical to those obtained by www.unitedsouls.fr from software manufacturers.

Article 8: Signature and evidence

The online provision of the credit card number and the final validation of the order will serve as proof of the entirety of the said order in accordance with the provisions of Law No. 2000-230 of March 13, 2000, and will imply the obligation to pay the amounts incurred by the entry of the products listed on the order form. This validation constitutes a signature and express acceptance of all operations carried out on the site.

Article 9: Delivery

The client has the choice to have the products delivered:

  • Either to their home,
  • Or to an address other than that of their billing. www.unitedsouls.fr commits to delivering the ordered items as soon as possible.

9.1. Shipping costs

The ordered products will be delivered to the address provided by the client. The shipping costs, which are in addition to the price of the products, are the responsibility of the client.

9.2. Delivery time

Unless in the event of force majeure, www.unitedsouls.fr commits to delivering the products as soon as possible, within the limits of available stocks. The delivery time starts from the order registration date, as indicated in Article 4 of these general terms and conditions of sale.

9.3. Delivery area

www.unitedsouls.fr commits to delivering the products offered for sale on its website in mainland France + Corsica and Monaco, as well as in the DOM-TOM and the following countries: Germany, Argentina, Australia, Austria, Belgium, Brazil, Canada, Chile, Denmark, Spain, Finland, Great Britain, Greece, Hungary, Ireland, Iceland, Italy, Luxembourg, Mexico, Norway, the Netherlands, Poland, Portugal, the Czech Republic, Slovakia, Slovenia, Sweden, Switzerland, USA.

Article 10: Verification of delivered products

The client is required to check the condition of the packaging and the conformity of the delivered products. Any claims regarding apparent defects or the non-conformity of the delivered products must be reported by the client within three working days from the date of receipt of the product by the client by sending:

Failing a claim made within the aforementioned time frame, the delivered products will be deemed compliant and accepted by the client. No product may be refunded before being returned and received by www.unitedsouls.fr in good condition, as delivered by www.unitedsouls.fr. In particular, the product must not be unsealed. Before returning the product to www.unitedsouls.fr, the client must contact www.unitedsouls.fr by email at ventes@UnitedSouls.fr.

Article 11: Client withdrawal period

The withdrawal period granted to the client for the purchase of goods, under the law, is seven clear days from the date of receipt of their order. During this period, the client may return the product(s) that do not suit them at their expense, without further penalties. In exchange for the return of the product(s), the client may obtain a refund of the amounts paid for the purchase of the products returned to www.unitedsouls.fr. It is understood that the product(s) returned by the client must be in good condition, as delivered by www.unitedsouls.fr, and accompanied by a copy of the original invoice. The products must be returned by the client to www.unitedsouls.fr, 62 avenue Saint-Exupery, 31400 Toulouse, France. Any product that is incomplete, damaged, or whose original packaging has been deteriorated will not be refunded or exchanged. However, this provision does not apply in the case of orders for unique products (product made and personalized according to the client’s specifications or product clearly customized for the client’s needs) for which the consumer cannot benefit from a withdrawal period of 7 days, in accordance with the provisions of Article L121-20-2 of the Consumer Code. The client is aware that they give concrete instruction to www.unitedsouls.fr to manufacture the merchandise when ordering such products.

Article 12: General refund conditions

Any refund owed by www.unitedsouls.fr will be made primarily by recrediting the credit card entered during the initial order or, if impossible, by bank check. This refund will be sent to the client within a maximum period of 30 (thirty) days from the receipt of the products in question and after verification of their condition. The return shipping costs are the sole responsibility of the client.

Article 13: Responsibilities

In accordance with Article 1147 of the Civil Code, www.unitedsouls.fr cannot be held liable for damages caused by the misuse of the products sold or due to their incompatibility with other products purchased by the client or any damages that are not caused by a breach of contract by www.unitedsouls.fr.

Article 14: Personal data

The client is informed that their personal data is subject to automated processing, which is necessary for the management of their orders. The information concerning the client is reserved for the use of www.unitedsouls.fr and its partners. The client has the right to access, modify, and delete their personal data, as provided by law. This right may be exercised by sending a written request to www.unitedsouls.fr, 62 avenue Saint-Exupery, 31400 Toulouse, France, or by email at contact@unitedsouls.fr.

Article 15: Intellectual property

The trademarks, logos, and products presented on the site www.unitedsouls.fr are the exclusive property of www.unitedsouls.fr. Any reproduction, representation, modification, or adaptation, in whole or in part, of these elements is strictly prohibited without the prior written consent of www.unitedsouls.fr.

Article 16: Force majeure

In the event of force majeure (natural disasters, strikes, lockdowns, etc.) leading to total or partial impediment of the performance of its obligations, www.unitedsouls.fr will not be liable for the delays incurred or the inability to deliver the products.

Article 17: Applicable law

These general terms and conditions of sale are governed by French law. Any dispute relating to the formation or execution of the contract will fall within the jurisdiction of the competent courts.
